Temporary construction fences in NYC are governed by citywide requirements under NYC Building Code §3307.7. The details that apply to your site depend on the project, fence location, and surrounding sidewalk conditions.
Sidewalk placement matters too. If a construction fence extends more than 3 feet onto the sidewalk, NYC DOB guidance indicates that a DOT permit is required. Fences also have to be located so they do not unreasonably obstruct pedestrian or vehicular access.
Queens sites need the same attention when the perimeter changes. A fence relocated for a new phase still has to meet the requirements that apply to its new location.
