1. About these terms

These terms govern your use of nationrentafence.com (the “Site”), operated by Nation Rent A Fence LLC, of 124-28 Queens Blvd, Kew Gardens, NY 11415 (“we,” “us,” “our”). By using the Site you agree to these terms. If you do not agree, please do not use the site.

2. These terms are not a rental agreement

Nothing on this Site constitutes an offer to rent equipment, and nothing here forms a rental contract. Equipment rental is governed by a separate written rental agreement entered into at the time of hire, which sets out rates, rental periods, deposits, delivery, damage responsibility and all other commercial terms. Where these terms and a signed rental agreement conflict, the rental agreement governs.

3. Enquiries and quotations

Information you submit through the Site or by telephone is treated as an enquiry, not an order. Any quotation we provide is:

subject to equipment availability at the time of booking;
based on the site information you give us, and may change if conditions differ on arrival;
valid for 30 days unless stated otherwise;
not binding until confirmed in writing and a rental agreement is executed.

4. Site information and accuracy

We aim to keep the Site accurate and current. Product descriptions, dimensions, specifications and availability are provided for general guidance and may change without notice. Equipment supplied may differ in specification from what is described here. Regulatory information on the Site, including references to the New York City Building Code, the Administrative Code and local laws, is provided for general information only. It is not legal or professional advice, and it may not reflect the current state of the law. See our Disclaimer for more.

5. Your responsibilities

If you enquire about or hire equipment, you are responsible for:

giving us accurate site information, including address, access, ground conditions and the intended use;
obtaining any permits, approvals or permissions required for the work, the site or the placement of equipment;
ensuring the intended installation complies with applicable codes and regulations;
ensuring safe access for delivery, placement and collection;
the equipment while it is in your possession, as set out in the rental agreement.

We do not obtain permits or approvals on your behalf, and we do not undertake to determine whether a particular installation satisfies any code or regulatory requirement.

6. Acceptable use of the Site

You agree not to use the Site to:

submit false, misleading or fraudulent information;
attempt to gain unauthorised access to the Site or any related system;
interfere with the Site’s operation, or introduce malicious code;
scrape, harvest or systematically extract content without our written permission;
use the Site for any unlawful purpose.

7. Intellectual property

The content of the Site, text, images, layout, graphics and design, is owned by us or used under licence, and is protected by applicable intellectual property laws. You may view and print pages for your own business purposes. You may not reproduce, republish or redistribute Site content for commercial purposes without our written permission.

8. Third-party links

The Site may link to third-party websites, including government and regulatory resources. We provide these for convenience. We do not control them, do not endorse them, and are not responsible for their content or availability.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential or special damages arising from your use of the Site or reliance on its content. Nothing in these terms limits liability that cannot lawfully be limited.

10. Indemnity

You agree to defend, indemnify, and hold harmless Nation Rent A Fence LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site or your breach of these terms.

11. Insurance

We carry general liability insurance. Certificates of insurance are available on request. Insurance requirements applicable to a particular hire are addressed in the rental agreement.

12. Changes to these terms

We may update these terms from time to time. The version published on this page applies from the date shown at the top. Continued use of the Site after an update constitutes acceptance.

13. Governing law

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any legal action or proceeding related to this Site shall be brought exclusively in the state or federal courts located in Queens County, New York.
